CONCOURT AFRAID TO STAY PETAUKE BY-ELECTION, MUST PROCEED
Constitutional Court Judge Chisunka has this morning refused to grant a conservatory order to restrain ECZ from proceeding with the Petauke By Election on the basis that public interest of the electorate in Petauke Central cannot be served if the conservatory order is granted and that the by-elections scheduled for 6th February, 2025 do not take place and that the petitioner has not shown the likelihood of success to justify the grant of the conservatory order.
This is a matter in which Isaac Mwanza has, on behalf of the Zambian Civil Liberties Union, sued the National Assembly and 2 Others for contravening the Constitution in the declaration ofPetauke Central seat vacant.
In the matter, Mr Mwanza alleges that the National Assembly and the Speaker exercised power which is vested on the Judiciary and the Tribunal when they declared the seat vacant, an action he alleges is unconstitutional and illegal.
The matter will now proceed to trial on the date to be announced by the Court soon.
