Lusaka woman weeps in court, narrating how son tried to penetrate his birth entrance

A 42-year-old woman was in tears yesterday in court as she narrated how her 22 year old biological son’s urinating utensil wanted to penetrate through the path that brought him into this world.

Seated in the accused’s dock, Fanizani Phiri, a second child among eight in his family, appeared at the Lusaka magistrate court for the charge of attempted rape before magistrate Mutinta Mwenya and pleaded not guilty.

Particulars of the offence are that Phiri, on Christmas last year, attempted to have unlawful carnal knowledge of his biological mother.

The complainant who is also a maid narrated that her biological son was drunk when he undressed himself in her presence with an erected penis.

She disclosed how her son undressed her and how she struggled to come out of his hoop.

However, the complainant shared that she gathered all the strength she could get, punched Phiri and shouted for help.

“On December 25, 2024, I went for work around 07:00 hours and when I knocked off around 12:00hours, and when I got home, I found that the children had not cleaned the house. I have eight children and stay with four of them, including the accused.”

“The kids I live with are Emmanuel, Moses, Blessings, Taonga and Fanizani Phiri. I started cleaning the house and when done, I started washing plates and after I was tired. I decided to rest on the chair. One of my daughters phoned and said she would come with her husband,” she said.

She said her child Taonga, aged 6, called her and informed her that Phiri had come and he seemed hungry.

“I sent Taonga to buy charcoal and I later told him to light the fire. While he was out preparing the fire. Phiri while drunk entered the house and as he tried to sit, he fell on me near the door and I pushed him. I told him he cannot sleep near the door because it is an exit. I told him to go and sleep elsewhere. He did not move,” she said.

The complainant said as she decided to bath the child, she went to the bedroom to get a dish, and as she wanted to go outside Phiri got up, blocked the door and undressed Infront of her.

“He blocked the door. I asked why, he undressed and came towards me. We struggled and managed to get off him and I punched him,” she said.

“I was scared. I shouted for help. A neighbour came and tried to open the door but my son tried to block the door, my neighbour pushed the door and the accused fell.”

She shared that Phiri undressed and she saw his nakedness, and the young man’s instrument was erect like a car jack ready to withstand the weight of a heavy vehicle.

“When we went outside, he slept and later got up and became violent and started breaking things and spilling water. The person I asked to beat him suggested that we go to police because it seemed he was not in his normal state. We reported to George Police Station.”

“We went to the police the following morning and asked them to release him but police officers refused and we stopped going there,” she added.

When asked to identify the accused, the complainant while weeping pointed at his son who was in the accused’s dock..

She cried stating that he was his second born son out of eight children she bore and they lived in harmony before the incident.

Meanwhile, a detective constable, Joy Kabunda from Matero Police told the court that on December 26, 2024 she reported for duty and was allocated a docket case of attempted incest in which RM is the complainant.

Kabunda said RM complained that her biological son attempted to have carnal knowledge of her after he undressed himself, removed his penis from his boxer which at the time was erect.

The officer said the complainant said the accused held his mother tight, but she fortunately escaped his hands as she screamed.

“The matter was reported to police. I later warned and cautioned the suspect brought in custody by the mother and neighbours and interviewed him. His response was that he didn’t know what came over him.
