The Immigration Department has been accused of contempt of court for allegedly failing to comply with a court order concerning the continued detention of Celestin Mambula Mukandila.
According to a media statement, the Court on September 9, 2026, ordered that Mr. Mukandila be brought before it within 48 hours.
The statement claims that the 48-hour period has since elapsed, but that the Immigration Department has not complied with the directive.
It further argues that the Court had already found Mr. Mukandila’s detention to be unlawful and that, in the absence of his production before the Court within the stipulated period, there is no lawful basis for his continued detention.
The statement is consequently demanding Mr. Mukandila’s immediate and unconditional release.
It says the continued detention of a person whose detention has allegedly been declared unlawful, coupled with the failure to comply with a direct court order, constitutes a serious affront to the rule of law and the authority of the Judiciary.
The statement further calls on the Immigration Department to immediately comply with the Court’s orders and release Mr. Mukandila.
It stresses that no institution is above the law and that court orders must be respected and obeyed.
