Constitutional Showdown: Lawyer Fights to Reverse Illegal Suspension of Top Judges!
A constitutional lawyer has contested the suspension of Constitutional Court judges, arguing that the move was both illegal and unconstitutional. The lawyer is now pushing for their immediate reinstatement.
Lusaka, Sept. 25 – Tresford Chali is seeking relief in the following matters:
He requests an interim order to halt the President’s decision, dated September 23, 2024, which suspended judges Anne Sitali, Mungeni Mulenga, and Palan Mulonda.
He calls for an order to bring the President’s decision, which accepted the Judicial Complaints Commission’s recommendation to suspend the judges, before the Constitutional Court for review and annulment.
He also seeks to have the report of the Judicial Complaints Commission, along with its findings and recommendations regarding the suspension of the judges, quashed by the Constitutional Court on the grounds of being unconstitutional. He asserts that the President’s suspension of the judges is null and void from the outset.
Chali further argues that the President’s actions violate Articles 143 and 144 of the Constitution.
Additionally, he seeks a declaration that the Judicial Complaints Commission does not have the authority to handle complaints against judges in cases where judicial interpretation of the law is involved.
He also requests compensation for the costs incurred during the proceedings and any other relief the court may deem appropriate.
