President Cyril Ramaphosa has asked the Western Cape High Court to halt the parliamentary impeachment process against him until the courts have ruled on the legality of the Section 89 Independent Panel report that recommended there may be grounds for further action over the Phala Phala matter.
In court papers, Ramaphosa argues that allowing the impeachment committee to proceed before the legal challenge is resolved would cause him “severe harm” and could result in an unfair process. His legal team maintains that it is appropriate for the court to first determine whether the panel’s report was lawful before Parliament continues with any impeachment-related proceedings.
The case forms part of the long-running legal dispute surrounding the Phala Phala matter and could determine whether Parliament can continue with the impeachment process while the report itself remains under legal challenge.
