NEPHEW DENIES SEX WITH UNCLE’S WIFE
A 44-year-old man of DSS 84 has sued his nephew, demanding K50,000 as compensation for allegedly having an affair with his wife while he was serving a prison sentence for stock theft.
Simon Siamumba sued Simulubeta Tawila, 37, of Chileya Village under Chief Musokotwane, accusing him of committing adultery with his wife, Charity Samani.
But Tawila, who appeared before Local Court Magistrate Esau Daka and Principal Presiding Local Court Magistrate Mubita Mubiana, denied the charge.
Siamumba told the court that he married Samani in 2007 after paying K3,500 as bride price. The couple has five children.
He said he was convicted of stock theft on October 22, 2022, and sentenced to five years’ imprisonment with hard labour, but served three years and four months before being pardoned.
“I was released, I went home only to discover that my wife had allegedly left for Lusaka. She stopped answering my calls. My children told me she has been in a relationship with Tawila while I was in prison. My daughter told me that she saw him coming out of our matrimonial bedroom,” Siamumba said.
He said he reported the matter to his in-laws, and his wife was summoned. According to Siamumba, she admitted to having a relationship with Tawila and asked for forgiveness.
Although he forgave her, Siamumba maintained that Tawila’s actions had caused him emotional distress and damaged his marriage.
He further told the court that his children informed him Tawila had been buying his wife gifts, including a phone, groceries and other items. He added that attempts to resolve the matter through traditional leadership failed.
A witness, Betty Muzingwani, 25, confirmed knowing both parties. She testified that Tawila used to send her to deliver items such as kapenta, sugar and vegetables to Samani, leading her to suspect they were in a relationship.
However, Tawila denied having an affair with Samani, stating that she was his uncle’s wife. He claimed he only interacted with her after she sought financial assistance.
He told the court that Samani had approached him through his aunt after needing K600 to support her business.
“I cannot pay for something I do not know. I have never had sex with his wife,” he said.
However, Samani admitted being in a relationship with Tawila while her husband was in prison.
She told the court that the relationship began after she borrowed K600 from him.
“We had sexual relations in our matrimonial bedroom in 2023. Tawila supported me by buying lotion and other necessities while my husband was incarcerated,” she said.
She also admitted exchanging romantic messages with Tawila via phone.
Samani told the court that Tawila once visited her home and was confronted by her first-born son, who accused him of having an affair with her.
“He attempted to meet me at a lodge, but I became fearful after learning that my husband had been released from prison,” she said.
The court is expected to determine whether Siamumba is entitled to compensation after hearing testimony from a witness who has been summoned.
