As High Court Rules in His Favor in the Given Lubinda Foundation Vs Councillor Mainda Simataa Case

The matter in which UPND Kamwala Ward Councillor Mainda Simataa was sued by Given Lubinda Foundation (GLF) under cause number 2022/HP/0304 in the High Court of Zambia has been dismissed for want of prosecution.
The matter is in relation to a cause were the Plaintiff (GLF) sued the Defendant, Councillor Simataa for interfering in the enjoyment of their ownership of a public Play Park which was duly leased to them by Lusaka City Council in 2019 for a period of 13 years.
In her ruling, High Court Judge, Lady Justice Situmbeko Chocho dismissed the case and awarded costs to the defendant, stating that the Plaintiff did not comply with Orders for Direction, did not appear before Court, and did not advance any excuse.
Meanwhile, Hon. Mainda Simataa who was represented by Counsel Frank Zulu of MZ Mwandenga and Company, says he will no longer be used to fight other people’s battles, adding that those who had vested interests in the property and instigated him to pursue the matter, abandoned him at the hour of greatest need, and left him to fight the battle and bare the costs alone.
