Court rules ZNFU president is still boss

THE Lusaka High Court has ruled that Zambia National Farmers United (ZNFU) president Jervis Zimba remains in office.

Judge Gaudentia Salasini dismissed an interim injunction issued on March 11, 2025, that had restrained Zimba from performing his duties.

The court had previously barred Zimba from holding office following a suit filed by former ZNFU Vice President Joseph Mungandi.

Mungandi argued that Zimba was unconstitutionally and illegally holding the ZNFU presidency and demanded his removal.

Former ZNFU vice president, Joseph Mungandi sued Zimba, Graham Mulders and Wilson Phiri in their capacity as trusties of ZNFU.

In an Ex parte injunction, the plaintiff sought to cancel a special meeting of the ZNFU Council that was scheduled for  March 13, 2025 in Lusaka.

In response, Zimba applied for the application to be discharged on the grounds that the plaintiff had not make full disclosure in his application.

And Judge Salasini found that Mungandi’s application for the injunction indeed, did not provide full disclosure of all material facts.

“Undoubtedly, the interim injunction created unreasonable interference with the rights of innocent third parties, who in this case are the counselors and members of ZNFU,” Judge Salasini stated in her ruling.

“From the afore stated, I accept the Defendant’s prayer that the interim injunction that was granted on 11th March, R-17 2025 should be discharged.”

The court discharged the interim injunction and ordered that the special meeting of the ZNFU Council, originally scheduled for March 13, 2025, be held immediately.

“I further grant costs to the Defendants which shall be paid forthwith or be taxed in default of agreement. Leave to appeal is granted,” ruled the court.
