CHAMA JAILED FOR HATE SPEECH, AS DPP REFUSES TO PROSECUTE UPND’S BATUKE IMENDA FOR HATE SPEECH

ZAMBIA Police has celebrated the jailing of Jackson Chama for hate speech by the Kalomo Magistrates Court in Southern Province.

This was after some.UPND party cadres complained against him in Kalomo.

According to Police, Chama was nabbed from his house in Lusaka’s Makeni and transported to Kalomo where he was aligned and jailed.

Police spokesperson Rae Hamoonga says Police is delighted to have successfully prosecuted and jailed Chama.

“The Zambia Police Service announces the successful conviction of Jackson Chama for the offense of Hate Speech. On February 17, 2024, Mr. Jackson Chama was apprehended in Lusaka and subsequently transferred to Kalomo, where the Docket of Hate Speech, contrary to Section 65 of the Cyber Security and Cyber Crimes Act of 2021, was opened. On March 13, 2024, Mr. Chama, aged 30 of House number 238 Makeni, appeared for plea before Honourable Mooya for the Offense of Hate Speech and pleaded guilty to the Charge,” he said in a statement.

Hamoonga has further stated that Magistrates Mooya sentenced Chama to 12 months with hard labour and that he remains remanded at Kalomo Prison.

“Today, March 18, 2024, the matter proceeded to the sentencing phase, and Mr. Chama has been convicted to serve One Year Imprisonment with hard Labour, effective from February17, 2024. He has been remanded at the Kalomo Correctional Service facility.
Additionally, the cell phone used to disseminate the hateful content on social media has been forfeited to the state. An order has been issued for its sale at auction, with the proceeds to be deposited into the Government Revenue account. The Zambia Police Service reiterates its commitment to upholding the law and ensuring that perpetrators of hate speech are brought to justice. We encourage all citizens to use social media responsibly and refrain from spreading hate speech or any form of discrimination,” he said.

And the Director of Public Prosecutions (DPP) Gilbert Phiri has refused the prosecution of UPND Secretary General Batuke Imenda for hate speech.

This was after PeP president successfully argued why the DPP should have allowed him to prosecute Imenda who called the Catholic Church Archbishop foe Lusaka Alick Banda Lucifer.
