The South African State is opposing an appeal by EFF leader Julius Malema against his firearm-related convictions linked to a shooting incident at the party’s 2018 anniversary celebrations.



Court papers reportedly argue that the discharge of the firearm was not accidental but a deliberate act. Prosecutors maintain that video footage, witness testimony and ballistic evidence support the conclusion that a real firearm was used.

Malema was convicted on charges including unlawful possession of a firearm, unlawful discharge of a firearm in a built-up area and reckless endangerment. His legal team has argued that the object used was a toy gun as part of a stage performance, but the State rejects that claim.

The State further argues that there is no reasonable prospect that another court would reach a different conclusion and wants the convictions to stand.
