PF TAKES ATTORNEY GENERAL TO COURT
…applies for Judicial Review in Police cancelation of meeting to review party Constitution

By Correspondent Reporter
THE Patriotic Front (PF) has sued the Attorney General, Mulilo Kabesha in the Lusaka High Court after the Zambia Police blocked them from conducting a constitutional review meeting in Chipata, Eastern Province in January, this year.

According to the affidavit filed in the High Court for judicial review, party deputy secretary general Nickson Chilangwa wants the court to declare the action or the decision of the police service to cancel indefinitely the constitutional review meeting which was scheduled to be held in Chipata on alleged account of unruly and violent behaviour portrayed by some senior party officials early this year as illegal, null and void.

Chilangwa says the action by police is not sanctioned by the law and therefore, it is illegal and unreasonable on the part of the Police.

He said a police officers in charge from Chipata Central Police identified as J. Ngoma, refused them an opportunity to hold a meeting on a pretext that senior PF members were unruly and violent.

Chilangwa has since sort a judicial review, stating that the decision by the police in a latter dated 11th January, 2023 purporting to decide to cancel the meeting indefinitely is illegal, null and void.

He also wants the court to declare that the Zambia Police erred in law by cancelling the meeting as the decision was not anchored on law but feelings.

Chilangwa stated that the Zambia Police did not follow the procedure in cancelling the meeting under the Public Order Act, which law does not accord the Police the power to cancel any meeting but advise for the suitable date for any said meeting.

He further stated that it was unreasonable on the part of the Police to cancel the meeting on ground of officials being unruly and violent. S
