Lusambo promises to pay back Kambita’s K650,000 balance in installments

INCARCERATED former Lusaka Province Minister Bowman Lusambo has informed the Lusaka High Court that he is willing to pay back in instalments the K650,000 balance he owes Zambezi East UPND Member of Parliament, Brian Kambita.

Lusambo submitted that he had paid Kambita K200,000 through his colleague and he is ready to pay the remaining balance in due course.

He says the investigation by the Anti-Corruption Commission ACC resulted in legal constraints and the impossibility of transferring clear and marketable title to the plaintiff.

Lusambo said the process caused frustrations and failure due to some circumstances.

In this case Kambita dragged incarcerated Lusambo to court for allegedly swindling him out of his K850, 000 on pretext he had a house to sell him.

Kambita had asked the court to order the former Kabushi MP to refund him K850, 000 which he paid him for the said house.

He further seeks a declaration that Lusambo was in breach of the contract, an order for damages for breach of contract, interest and costs.

But Lusambo said he is willing to pay back the money in installments.

He said he paid back the sum of K200,000 through a colleague, Brian Savale.

“The defendant further avers that he did made efforts to resolve the matter amicably with the plaintiff and the defendant paid back to the plaintiff a sum of K200,000 through a colleague of the plaintiff, Mr Brian Savale,” read the file.

And upon the agreement on paying the remaining balance, the plaintiff requested to hold on to two other certificates of title from the defendant as collateral for the money.

Lusambo pleaded and acknowledged the financial implications for the plaintiff due to the contract’s frustrations and he is willing to repay any sums received under the contract in instalments.
