IF DR. RON MWAMBWA WAS NEVER OFFICIALLY APPOINTED AUDITOR GENERAL, WHAT HAS HE BEEN DOING IN THAT OFFICE?

Apart from the sorrow surrounding the passing of FDD leader Edith Nawakwi, Zambians today woke up to a different kind of shock—one that questions the very integrity of our public institutions.

According to an affidavit submitted to the Constitutional Court, Dr. Ron Mwambwa has denied ever being officially appointed as Auditor General of Zambia. This statement, made under oath, directly contradicts a press release dated September 25, 2023, issued by State House through Chief Communications Specialist Clayson Hamasaka, which clearly stated that President Hakainde Hichilema had appointed Dr. Mwambwa as Auditor General pursuant to Article 249(1) of the Constitution.

But now, in a twist straight out of a legal thriller, Dr. Mwambwa, through his lawyer Munalula Michael Liweleya, claims that a press release does not equate to a formal appointment—and therefore, he has never officially held the position.

If that’s the case, what in the world has Dr. Ron Mwambwa been doing in the Office of the Auditor General for months?

This isn’t just a case of bureaucratic oversight. This is a national scandal. The Law Association of Zambia (LAZ), in its petition, argues that:
1. Dr. Mwambwa’s appointment was never ratified by the National Assembly as the law demands.
2. He is over 60 years of age, exceeding the constitutional retirement age.

These are not new arguments. Civil rights activists like Brebnar Changala, some Members of Parliament, and the Zambian Whistleblower platform flagged these very concerns last year. Yet their voices were drowned out—until now.

LAZ’s legal challenge rests on Articles 249(1), 259(1)(a), and 252(1) of the Constitution. These articles were clearly referenced in the now-controversial press release (see image) that was widely shared and cited as a legitimate appointment at the time.

But today, in the court of public opinion and in the Constitutional Court itself, the truth is catching up.

As John 8:32 says:
“And you will know the truth, and the truth will set you free.”

So we ask once more: If Ron Mwambwa was never formally appointed, why has he been acting as Auditor General? Who authorised his presence, decisions, and actions in that office?

Zambia deserves answers. Not PR.m
