A Legal battle of epic proportions is loading in the Lusaka High Court as UNZA lecturer of law Dr O’Brien Kaaba says he is itching to go head to head with Solicitor General Marshal Muchende in Court, and bring to light his alleged shady dealings.
In a letter addressed to Muchende’s lawyers Andrew and Partners, Dr Kaaba said he is glad that Muchende has dragged their war to Court, so that he can prove his ‘entanglement’ in graft using State Chambers.
Muchende has sued Dr Kaaba in the Lusaka High Court for putting a black mark against his name when he alleged that he was abusing his position and the office of the Attorney General to cover corruption and cut deals with wrong doers.
Dr Kaaba who is a former board member of the Anti-Corruption had alleged that Muchende was working hand in glove with former ACC director general Thom Shamakamba to get kickbacks from corrupt individuals who were willing to pay money in exchange for their freedom.
The revelations by Dr Kaaba led to the dissolution of the ACC board by President Hakainde Hichilema, who condemned the act of disclosing confidential information before investigation officers have a case, or proving whether corruption accusations against certain individuals are true.
Dr Kaaba has however asked Muchende’s lawyers to serve him with the court documents so that he can spill the tea.
“It has been brought to my attention that various social media platforms are circulating a writ of summons and statement of claim purported to have been issued by your firm on behalf of your client Mr Marshal Mubambe Muchende, the current Solicitor General of the Republic of Zambia, reportedly suing me for defaming him,” the letter read.
“The said documents indicate that they were filed in the Lusaka High Court on 18 th July, 2024. If indeed this is the correct position, could you kindly serve me the process so that I can file my defence and defend myself before a properly constituted court of competent jurisdiction and not social media.”
He gave a toast to Muchende for giving him a chance to prove his allegations and took the dare, with a promise to fight to the finish.
“I must end by commending your client for commencing this action as it will give me an opportunity to demonstrate before Court the truthfulness of my assertions and I eagerly look forward to meeting him in Court,” said Dr Kaaba.
