FORMER Disaster Management and Mitigation Unit (DMMU) National Coordinator Chanda Kabwe has been dragged to court over non-payment of K100,000 balance for a Volvo truck he bought at K300,000 from a Lusaka woman.
The complainant, Catherine Kunda, has since asked the Lusaka High Court to order Mr Kabwe to return he truck in question in the same state he go it as of March 2022 and also pay damages for inconvenience of non-payment of the outstanding balance and loss of use of the car.
Further, she seeks an order that the simple contract for the sale of the Volvo truck registration number AHB 7389ZM between the parties to be cancelled forthwith.
In a statement of claim, Ms Kunda has submits that she was trading in transportation business while the defendant was a high ranking official in the Patriotic Front (PF) government.
“Sometime in December 2021, the plaintiff agreed to sell a truck to the defendant. The defendant agreed to buy the plaintiff’s light truck registration number AHB 7389ZM at a total cost of K330,000,” Ms Kunda has submitted.
She submits that she later surrendered the truck to the defendant who paid an initial deposit of K120,000 cash in December 2021 and remained with a K210,000 balance.
“The parties did not execute a formal contract of sale document but it was mutually agreed that the defendant shall settle their outstanding balance of K210,000 in full by monthend of January 2022,” the document reads.
Ms Kunda submits that Mr Kabwe failed to honour his promise of settling the outstanding balance in full by the end of January 2022 and only managed to pay a paltry K100,000 in March 2022 bringing the total amount paid to K220,000.
“Since March 2022, the defendant has neglected or refused to settle the outstanding balance,” the document reads.
Ms Kunda bemoans that as a result, she has suffered loss and damages in term of use of the motor vehicle.
