ATTORNEY GENERAL KABESHA URGES DISMISSAL OF EDGAR LUNGU’S BID TO RECUSE JUDGES IN ELIGIBILITY CASE
Attorney General Mulilo Kabesha has called on the Constitutional Court to reject former President Edgar Lungu’s application seeking the recusal of three judges from deliberating on his presidential eligibility case. Lungu raised concerns about potential bias involving Constitutional Court President Margaret Munalula, Deputy President Arnold Shilimi, and Justice Mapani Kawimbe.
Kabesha argued that Lungu has failed to provide evidence of bias or explain how President Hakainde Hichilema would be the primary beneficiary if the judges remain on the case.
The court is set to hear Lungu’s formal application for the judges’ recusal today Thursday 3rd October 2024, following an earlier adjournment after Lungu raised concerns over the judges’ proximity to President Hichilema, given the relevance of the case to the 2026 elections.
The main case, brought by UPND youth Michelo Chizombe, challenges Lungu’s eligibility to contest the 2021 elections and could impact his potential candidacy in 2026. Chizombe is seeking to overturn previous Constitutional Court rulings on the matter.
